Acceptable Use Policy
What you may and may not do with NOWScale — covering prohibited content, platform manipulation, technical limits, AI use and how we enforce.
Short version: publish content you have the right to publish, to accounts you are allowed to publish to, in ways the destination platforms permit. Do not use NOWScale to fake engagement, spam, impersonate, or deceive. The operative text below governs.
1. Purpose and scope
This Acceptable Use Policy (the "Policy") sets out the conduct and content rules for the NOWScale platform operated by NOWScale LLC. It is incorporated into the Terms of Service, and capitalised terms not defined here have the meaning given there. Breaching this Policy is a breach of the Terms.
This Policy applies to:
- every person who accesses the Service, including account holders, workspace members, invited collaborators, agency staff and clients;
- all content uploaded to, generated within, scheduled through, or published by the Service;
- all traffic to our API and all webhook and integration activity conducted with your credentials;
- activity on Connected Accounts to the extent it is carried out through the Service.
Two rules run underneath everything below. First, you must have the right to publish what you publish. Second, you must have authorisation for every account you publish to. If either is missing, the activity is prohibited regardless of whether it appears elsewhere in this Policy.
This Policy sets a floor, not a ceiling. Each destination platform has its own rules, and content permitted here may still be prohibited there. You are responsible for complying with both.
2. Prohibited content
Do not upload, generate, schedule, publish or transmit content that:
2.1 Is illegal or exploitative
- violates any applicable law, regulation or court order, or promotes or facilitates unlawful activity;
- sexualises minors in any way, including child sexual abuse material. We have zero tolerance for this. Accounts are terminated immediately without notice, material is preserved as required by law, and reports are made to the appropriate authorities and reporting bodies;
- depicts intimate or sexual imagery of a person shared without their consent, or threatens to share such imagery;
- sexualises, endangers or exploits any person, or facilitates human trafficking or forced labour;
- depicts gratuitous violence or graphic injury for shock value, or glorifies, incites or provides instruction for violence, terrorism or mass harm;
- promotes suicide, self-harm or disordered eating, or provides methods or encouragement for them.
2.2 Infringes rights
- infringes copyright, trademark, patent, trade secret, database, moral, publicity or privacy rights — including reuploading another creator's video, using unlicensed music or stock footage, or using a brand's marks without permission;
- discloses another person's private information — home address, phone number, government identifiers, financial account details, private medical information, precise location — without their consent;
- breaches a duty of confidence or discloses trade secrets you were entrusted with.
2.3 Is technically harmful
- contains malware, ransomware, spyware, cryptominers or other malicious code;
- links to phishing pages, credential-harvesting forms, or sites that impersonate a legitimate service;
- contains hidden redirects, cloaked destinations, or link shorteners used to disguise a harmful target.
2.4 Violates a destination platform's rules
Content that a Third-Party Platform prohibits may not be published to that platform through the Service, even if it is permitted elsewhere. This includes format, length, disclosure, branded content, political advertising and monetisation rules specific to that platform.
2.5 Promotes regulated goods and services
Content promoting the sale of firearms, ammunition, explosives, controlled substances, prescription medication, tobacco and vaping products, alcohol, gambling, adult services, cryptocurrency investment schemes, or high-risk financial products is prohibited unless you are lawfully licensed to do so, the promotion complies with all applicable laws in every market it reaches, and the destination platform permits it.
2.6 Categories requiring particular care
The following are not banned outright, but carry heightened responsibility, and we apply closer scrutiny to them:
- Health and medical claims — do not present unproven treatments as effective, discourage evidence-based care, or make therapeutic claims for products not authorised to carry them.
- Financial claims — do not promise returns, present hypothetical or cherry-picked results as typical, or promote schemes that depend on recruitment. Income and results claims must be substantiated and appropriately qualified.
- Elections and civic processes — do not misrepresent voting procedures, eligibility, dates, locations or results, and comply with all applicable political advertising disclosure rules.
- Crisis events — do not spread unverified claims during emergencies in ways that could impede response or endanger people.
3. Prohibited conduct
This section is about how the Service is used, rather than what is in the content itself.
3.1 Platform manipulation and inauthentic engagement
Do not use the Service to:
- generate, purchase, sell, exchange or solicit artificial followers, subscribers, views, watch time, likes, comments, shares, saves or other engagement signals;
- operate or coordinate networks of accounts designed to appear independent while acting in concert, including bot networks, sockpuppet accounts and engagement pods;
- participate in engagement farming, follow-for-follow, comment-loop or view-exchange schemes;
- repeatedly publish identical or near-identical content across many accounts to inflate distribution;
- use misleading thumbnails, titles, captions or hooks that materially misrepresent the content behind them.
3.2 Spam and unsolicited messaging
- no unsolicited bulk messaging, mass direct messaging, mass commenting, mass tagging or mass mentions;
- no publishing at volumes or frequencies designed to flood a feed or crowd out other content;
- no using the Service to distribute content to lists assembled without the recipients' consent, or in breach of applicable electronic marketing law.
3.3 Impersonation and deception
- do not impersonate any person, brand, public figure or organization, or falsely imply affiliation, endorsement or partnership;
- do not impersonate NOWScale, our staff, or a Third-Party Platform, including in support requests;
- do not misrepresent your identity, location or the origin of your content to obtain access, distribution or monetisation.
3.4 Deceptive monetisation
- no undisclosed paid promotion, sponsorship or affiliate content where disclosure is required by law or platform rules;
- no fake reviews, testimonials or endorsements, and no incentivised reviews presented as organic;
- no bait-and-switch offers, hidden subscription terms, or funnels designed to obscure price or cancellation;
- no pyramid, matrix or chain-referral schemes.
3.5 Unauthorised publishing
- do not connect or publish to any account you do not own or are not expressly authorised in writing to manage;
- if you manage accounts for clients, keep evidence of that authorisation and end the connection when the engagement ends;
- do not use another person's credentials or retain access after your authorisation is withdrawn.
3.6 Circumventing platform controls
- do not use the Service to evade a Third-Party Platform's rate limits, publishing quotas, content restrictions, age gates, geographic restrictions or moderation systems;
- do not create replacement accounts to evade a suspension or ban imposed by a Third-Party Platform or by us;
- do not obscure content from moderation systems using techniques such as text-in-image evasion, deliberate misspelling of prohibited terms, or frame manipulation.
4. Technical restrictions
- Access methods. Access the Service only through our published interfaces and API. Do not scrape, crawl, harvest or bulk extract data from the Service or from Third-Party Platforms beyond what their official APIs permit.
- Reverse engineering. Do not decompile, disassemble, reverse engineer, or attempt to extract source code, model weights, prompts or training data from the Service, except where that restriction is prohibited by applicable law.
- Security testing. Do not probe, scan, penetration test, fuzz, or attempt to bypass authentication, authorisation, rate limiting or tenant isolation without our prior written permission. Coordinated disclosure requests and vulnerability reports are welcome at support@nowscale.com.
- Credentials. Do not share, sell or publish account credentials, API keys, access tokens or webhook secrets. Each User must have their own seat; credential sharing to avoid seat charges is prohibited. Rotate any credential you believe has been exposed.
- Service integrity. Do not interfere with the Service or with the experience of other customers — including denial-of-service attempts, deliberately malformed requests, resource exhaustion, or attempts to access data belonging to another workspace.
- Rate limits and fair use. Respect the published rate limits for your plan. Implement exponential backoff on retries, honour throttling responses, and do not distribute requests across multiple keys or accounts to defeat a limit. Even where no numeric limit is published, usage must be reasonable relative to your plan and must not degrade the Service for others. Sustained excess may result in throttling, an upgrade requirement, or overage billing under the Terms.
- Automation. Automated publishing is a core feature and is permitted, but automation must not be used to accomplish anything otherwise prohibited by this Policy.
5. AI-specific rules
The Service includes AI-assisted features such as hook and retention analysis, caption generation and scheduling recommendations. In addition to everything above, you must not:
- use AI features to create synthetic or manipulated media depicting a real, identifiable person saying or doing something they did not, without that person's consent and without clear disclosure that the content is synthetic;
- generate synthetic voices or likenesses of real people, including public figures and deceased persons, for endorsement, political or deceptive purposes;
- publish AI-generated content in categories where a destination platform requires an AI disclosure label without applying that label;
- use AI features to mass-produce low-value content intended solely to game distribution or monetisation systems;
- attempt to manipulate our models through prompt injection, jailbreak attempts, or inputs designed to elicit prohibited output;
- rely on AI Output without human review — you remain responsible for everything you publish, including factual accuracy and required disclosures.
6. Enforcement
We do not pre-screen content, but we investigate reports and signals of misuse. When we identify a violation, or reasonably suspect one, we may take any of the following actions, alone or in combination, depending on severity, intent, the harm caused, and any history of prior violations:
- request information or clarification from you;
- issue a warning describing the violation and how to correct it;
- remove, unpublish, cancel scheduled delivery of, or restrict specific content;
- throttle, restrict or disable specific features, integrations or API access;
- disconnect Connected Accounts, or restrict publishing to particular platforms;
- suspend the affected User, Workspace or Account;
- terminate the Account under the Terms of Service;
- report the matter to a Third-Party Platform, to law enforcement, or to another appropriate authority where the law requires it or where there is a risk to safety.
We generally start at the lowest step that addresses the problem. We will move directly to suspension or termination without prior warning where there is a serious or immediate risk — including child sexual abuse material, credible threats of violence, coordinated fraud, security attacks against the Service, or conduct that jeopardises our access to a Third-Party Platform's API.
Enforcement does not entitle you to a refund of fees for content or access lost as a result of a violation, and it does not limit any other remedy available to us under the Terms or at law.
6.1 Appeals
If you believe an enforcement decision was mistaken, write to support@nowscale.com within thirty (30) days of the decision. Include your account or workspace identifier, the action taken, the date, and why you believe it was incorrect, with any supporting evidence such as licences, releases or client authorisations. We aim to acknowledge appeals promptly and to have a person who was not involved in the original decision review it. We will tell you the outcome and, where the appeal succeeds, restore access or content where it is still technically possible to do so. Appeals of decisions made by a Third-Party Platform must be raised with that platform; we cannot overturn them.
7. How to report abuse
Report suspected violations of this Policy to support@nowscale.com. A useful report includes:
- links to the content or the account involved;
- which part of this Policy you believe was breached, in your own words;
- dates, times and screenshots or other evidence;
- your relationship to the matter, and how we can reach you for follow-up.
Copyright and trademark complaints should be sent to support@nowscale.com and are reviewed promptly. Security vulnerabilities should go to support@nowscale.com. Privacy concerns should go to support@nowscale.com. Harassment or conduct issues involving people rather than content are also covered by this Policy.
We treat reports confidentially where we can, though we may need to share details to investigate or where the law requires it. Do not submit reports in bad faith or to gain a competitive advantage; abuse of the reporting process is itself a violation of this Policy.
8. Changes to this Policy
We will update this Policy as the platform, the destination platforms and the law evolve. Material changes are notified as described in the Terms of Service. The date at the top of this page shows when the current version took effect. Continued use of the Service after a change takes effect means you accept the updated Policy.
